FINANCE ACT 2023 IMPLEMENTATION STILL SUSPENDED BY THE COURTS

The High Court has declined to lift conservatory orders suspending the implementation of the controversial Finance Act 2023.

In a ruling delivered by the High Court in Milimani Nairobi on Monday, July 10, 2023, Justice Mugure Thande said the status quo will remain until the petition by Busia Senator Okiya Omtatah and six others is heard and determined.

Justice Thande said that the government failed to demonstrate that it will suffer losses if the orders are not lifted. The government through the Attorney General had sought to have the conservatory orders granted two weeks ago set aside.
